IMPORTANT LEGAL NOTICE: Please read these Terms of Service carefully before using our platform. By accessing or using My Body Labs, you agree to be bound by these terms. If you do not agree, do not use the platform.

1. About My Body Labs

My Body Labs LLC (“My Body Labs,” “we,” “us,” or “our”) operates a telehealth technology platform that facilitates connections between patients and licensed, independent healthcare providers and licensed 503A compounding pharmacies. We are incorporated in the State of Florida.

My Body Labs is a technology management services company. We are NOT a medical practice, healthcare provider, pharmacy, or medical group. We do not practice medicine, provide medical advice, diagnose conditions, or prescribe medications. All clinical services are provided by independently contracted licensed physicians who operate through a separately structured Professional Corporation.

THE INFORMATION, SERVICES, AND CONTENT PROVIDED THROUGH MY BODY LABS DO NOT CONSTITUTE MEDICAL ADVICE AND ARE NOT A SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT. ALWAYS SEEK THE ADVICE OF YOUR PHYSICIAN OR OTHER QUALIFIED HEALTH PROVIDER WITH ANY QUESTIONS YOU MAY HAVE REGARDING A MEDICAL CONDITION.

If you think you may have a medical emergency, call your doctor or 911 immediately. My Body Labs does not recommend or endorse any specific tests, physicians, products, procedures, or opinions that may be mentioned on the platform.

3. Eligibility and Account Registration

3.1 Age Requirement

You must be at least 18 years of age to use My Body Labs. By using the platform, you represent and warrant that you are at least 18 years old.

3.2 Geographic Eligibility

The platform is available to residents of the United States. Services may not be available in all states and are subject to applicable state telehealth laws and physician licensure.

3.3 Account Accuracy

You agree to provide accurate, current, and complete information during registration and to update this information to keep it accurate. Providing false health information may result in inappropriate medical recommendations and could endanger your health.

4. Telehealth Services

4.1 Nature of Telehealth

My Body Labs facilitates telehealth consultations between patients and independently contracted licensed physicians. Telehealth services are provided remotely via electronic communications technology.

4.2 Physician Independence

All physicians who provide services through the My Body Labs platform are independent contractors, not employees of My Body Labs. These physicians operate through a separately organized Professional Corporation. My Body Labs does not control the practice of medicine or the clinical decisions made by physicians.

4.3 Informed Consent to Telehealth

By using telehealth services through My Body Labs, you acknowledge and consent to the following:

Medications dispensed through My Body Labs are compounded by licensed 503A compounding pharmacies pursuant to valid patient-specific prescriptions from licensed physicians. Compounded medications:

5. Membership, Fees, and Payment

5.1 Subscription Fees

My Body Labs operates on a subscription membership model. Membership fees are disclosed at enrollment and billed on a recurring monthly basis. Fees may change with 30 days advance notice.

5.2 Cancellation Policy

You may cancel your membership at any time. Cancellation takes effect at the end of the current billing period. No prorated refunds are provided for the current billing period.

5.3 Billing Disputes

If you believe you have been incorrectly billed, contact support@mybodylabs.com within 60 days of the charge. We will respond within 10 business days.

My Body Labs is committed to protecting your health information in accordance with HIPAA and applicable state privacy laws. Our complete privacy practices are described in our Privacy Policy, which is incorporated into these Terms by reference. By using My Body Labs, you acknowledge receipt of our Notice of Privacy Practices.

8. Disclaimers and Limitation of Liability

THE PLATFORM IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, MY BODY LABS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE PLATFORM.

In no event shall the total liability of My Body Labs to you for all claims exceed the greater of: (a) the total amount paid by you to My Body Labs in the preceding 12 months, or (b) one hundred dollars ($100).

9. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Florida. Any dispute arising out of or relating to these Terms shall be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. YOU AND MY BODY LABS AGREE THAT EACH MAY BRING CLAIMS ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS PART OF A CLASS ACTION.

10. Modifications and Termination

We reserve the right to modify these Terms at any time with notice. Your continued use of the platform after changes constitutes acceptance. We reserve the right to terminate accounts for violation of these Terms.
